Compass Group USA, Inc. Sued In Class Action For Failing To Pay Delivery Drivers In Compliance With California Labor Laws

SAN FRANCISCO, June 21, 2017 /PRNewswire/ -- Kaplan Fox & Kilsheimer LLP (www.kaplanfox.com) filed a federal class action law suit against Compass Group USA, Inc. ("Compass Group" or the "Company"), on behalf of all employees who worked as route and delivery drivers in California since June 20, 2013. The lawsuit alleges that Compass Group failed to comply with the mandates of the California Labor Code.  As a result, Plaintiffs allege that Compass Group has underpaid its workers and denied them meal and rest breaks required by law.  

Specifically, the complaint alleges that Compass Group has failed to pay its route and delivery drivers who work for its 'Canteen' or 'Canteen Vending' brand (http://www.canteen.com/) minimum and overtime wages. Compass Group's route and delivery drivers service vending machines and corporate cafeterias throughout the state of California.  The lawsuit alleges Compass Group has systematically run afoul of California's Labor Code in numerous ways, including its failure to keep and maintain adequate records of hours worked, engaging in a policy and practice of refusing to provide workers meal and rest breaks, failing to provide a mechanism for workers to receive payments and penalties for missed breaks, failing to compensate workers for "off-the-clock" work before and after their shifts, failing to reimburse workers for company-mandated use of their cell phones, and failing to pay all wages, overtime and commissions in compliance with California law.  

"Employees today are under increasing pressure from their employers to do more in less time to help the company's bottom line and keep their jobs," stated Matthew George, an attorney for the proposed class.  "Because of Compass Group's labor practices, the hard-working route and delivery drivers we represent have lost out on wages, reimbursements, and other compensation due under California law and we intend to recoup what they are owed."  

The complaint alleges violations of the California Labor Code and the California Unfair Competition Law. The case, entitled Johnson, et al. v. Compass Group USA, Inc., No. 17-cv-03543, is currently pending in the United States District Court for the Northern District of California.
