Industry Files Comments Opposing Beverage Tax Regulations In Philadelphia

The Tri-State Automatic Merchandising Council and individual member companies filed comments with the City of Philadelphia on behalf of the industry opposing the overly-burdensome proposed regulation to implement the Sugar Sweetened and Beverage Tax, passed by the City Council and Mayor.  

The City's beverage tax is scheduled to go into effect January 1, 2017. However, the American Beverage Association is challenging the tax.  

The comments filed by Tri-State raise the following issues regarding the potential impact of the regulation: 

  1. Operators would face increased costs for warehousing, tracking, recordkeeping and compliance 
  2. The significant number and diversity of beverages being taxed would create a financial burden and difficulty in ascertaining applicability 
  3. The date of compliance implementation is not attainable 
  4. Operators and Distributors should receive a portion of the tax for remitting such
